Quin Projects Terms of Service

1. Acceptance of Terms

By accessing and using the services of Quin Projects Pty Ltd ("Quin Projects," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. These Terms apply to all clients, customers, and users of our construction and building services.

2. Services Description

Quin Projects provides comprehensive construction services including but not limited to:

  • Residential construction and renovations
  • Commercial building projects
  • Institutional construction
  • Building maintenance and repairs
  • Waterproofing and structural services
  • General construction activities throughout NSW

3. Quotes and Estimates

All quotes and estimates provided by Quin Projects are:

  • Valid for 30 days from the date of issue unless otherwise specified
  • Based on information provided by the client at the time of quotation
  • Subject to site inspection and verification of existing conditions
  • Exclusive of GST unless otherwise stated
  • Subject to change if project specifications or site conditions differ from initial assessment

4. Contract Formation

A binding contract is formed when:

  • You accept our written quote or proposal
  • We receive your signed contract or purchase order
  • We commence work with your authorization

All contracts are subject to these Terms and any additional terms specified in the project contract.

5. Payment Terms

5.1 Payment Schedule

  • Deposit: 20% of total project value upon contract signing
  • Progress payments: As specified in individual contracts
  • Final payment: Due upon completion and handover

5.2 Late Payments

Late payments may incur interest charges at 1.5% per month. We reserve the right to suspend work for non-payment and may require payment of outstanding amounts before resuming services.

6. Project Timeline and Delays

While we strive to complete projects within agreed timeframes, delays may occur due to:

  • Weather conditions
  • Material availability and delivery delays
  • Regulatory approvals and inspections
  • Client-requested changes
  • Unforeseen site conditions
  • Force majeure events

We will notify you promptly of any anticipated delays and work to minimize their impact.

7. Client Responsibilities

Clients are responsible for:

  • Providing accurate project information and requirements
  • Obtaining necessary permits and approvals
  • Ensuring site access and security
  • Providing utilities and services as required
  • Making timely decisions and approvals
  • Compliance with local regulations and bylaws

8. Quality and Warranty

We are committed to delivering high-quality construction services in accordance with:

  • Australian Building Codes and Standards
  • Industry best practices
  • Contract specifications
  • Relevant regulations and compliance requirements

Our work is covered by applicable warranties as specified in individual contracts and statutory warranties under Australian Consumer Law.

9. Limitation of Liability

To the maximum extent permitted by law, Quin Projects' liability is limited to the contract value. We are not liable for indirect, consequential, or special damages. Our liability is subject to the limitations and exclusions permitted under Australian Consumer Law and other applicable legislation.

10. Insurance and Indemnity

Quin Projects maintains appropriate professional indemnity and public liability insurance. Clients must maintain their own insurance coverage for property and contents. Each party indemnifies the other against claims arising from their own negligence or breach of contract.

11. Dispute Resolution

In the event of disputes, we encourage resolution through:

  1. Direct negotiation between parties
  2. Mediation through an agreed mediator
  3. Arbitration if mediation fails
  4. Legal proceedings as a last resort

12. Termination

Either party may terminate a contract with written notice. Termination does not affect rights and obligations accrued before termination. Clients remain liable for work completed and materials ordered up to the termination date.

13. Force Majeure

Neither party is liable for delays or failures due to circumstances beyond their reasonable control, including natural disasters, government actions, pandemics, or other force majeure events.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any legal proceedings must be conducted in the courts of New South Wales.

15. Changes to Terms

We may update these Terms from time to time. Changes will be posted on our website with a new "Last updated" date. Continued use of our services after changes constitutes acceptance of the updated Terms.
